Wrist Injury. $120,000

Our client sustained a soft tissue wrist injury in a slip and fall during the course of her employment. She had 6 weeks off work and then returned on light duties for a short period before returning to normal duties. She was offered $0 by the insurer on the basis that her injury gave rise to a 0% Permanent Impairment. She commenced a damages claim, and at the compulsory conference was offered $10,000 clear of the refund to insurer. At our recommendation, she elected to sue. At the trial recently she was awarded in excess of $120,000 clear of the insurer refund. She was incredibly pleased with the result.

Ulcer to lower leg . $50,000

Our client sustained a severe ulcer after contact at work with acid. The injury forced our client to change jobs, and suffer a cut in pay. He was offered a lump sum by WorkCover of $913.20 when they closed his claim file. We recommended that he reject this offer and after commencing a common law damages claim on his behalf, we settled his claim for $50,000 during negotiations following a settlement conference.

Our client sustained a psychological injury during the course of his employment. As his injuries had a major impact on his work and day to day activities, he medically retired as he was unable to continue. A claim was lodged with WorkCover where he received statutory benefits for lost wages and medical expenses. When his statutory claim concluded, our client was offered a minimal lump sum payout. He turned down the lump sum offer and pursued a claim for negligence against his employer. The claim went to conference and settled for $400,000. Our client was extremely pleased with this result.

Our client injured his foot at work. After making a claim for lost wages and medical expenses with WorkCover, a lump sum payout was offered to him. He declined to accept this offer as it did not adequately compensate him for the impact it made on his day to day life and the restrictions his injury placed on his work capacity. Upon our advice, he instructed to pursue a claim for negligence. His matter proceeded to conference and settled for $89,500.

Our client sustained serious physical injuries from a motor vehicle colliding with his motorcycle at an intersection. As a result, he had to have extensive time away from work. Our client was cycling on the Sunshine Coast and in the course of adjusting her line of travel she rode over a storm water drain cover on the road. Her front wheel went into the drain, and she fell from her bike into the gutter, breaking her elbow. She was left with residual permanent impairment, but had returned to her usual employment duties. Liability was in issue and the claim was settled in conference with the local council for $90,000.

Our client sustained injuries when she tripped on a protrusion which formed part of the parking structure in a major shopping centre. She was an older lady who fell heavily and sustained injuries to her face and head. Following the incident our client’s memory was affected and she required assistance with many tasks of daily life. The owners of the car park and the tenants of the shopping centre offered no monetary compensation in connection with our client’s injuries. After commencing a claim process, we settled our client’s claim at settlement conference for $85,000.00.

Criminal Compensation
Multiple stab wounds. $42,750

Our client was stabbed through the hand and shoulder. His hand was permanently damaged and he suffered extensive psychological trauma. He was eventually required to change jobs and move interstate. We obtained an order from the court that the offender pays the victim $42,750 to compensate him for the injuries caused by the attack.
